GANESH EVENT GUEST WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK Event: Ganesh Celebration Organizer: Ganesh Event Organizers Location: Shiloh Woods – Community Common Area Event Date: September 19, 2026 PLEASE READ CAREFULLY BEFORE SIGNING In consideration of being permitted to attend and/or participate in the Ganesh Celebration ("Event"), I acknowledge and agree to the following: 1. VOLUNTARY PARTICIPATION I understand that attendance at and participation in the Event are voluntary. I am attending and participating at my own risk. The Event may include religious and cultural activities, cultural performances, dances, skits, music, food and beverages, tents and temporary structures, decorations, electrical equipment, lighting, seating areas, walking areas, and other activities associated with a community gathering. 2. ASSUMPTION OF RISK I understand and voluntarily assume the risks associated with attending or participating in the Event, including, but not limited to: • slips, trips, and falls; • uneven, wet, muddy, or otherwise hazardous ground or walking surfaces; • risks associated with tents, temporary structures, tables, chairs, decorations, and equipment; • injuries arising from dances, skits, performances, rehearsals, or other cultural activities; • accidental contact with performers, participants, guests, equipment, or property; • food-related illness or allergic reactions; • burns or injuries associated with cooking, lighting, candles, incense, electrical equipment, or similar items; • weather conditions, including heat, rain, wind, storms, or lightning; • injuries or incidents involving children or other guests; • parking, pedestrian, and vehicle-related risks; • loss, theft, or damage to personal property; and • other risks that may reasonably arise from attending or participating in a community cultural event. I understand that I am responsible for exercising reasonable care for my own safety and for supervising any children in my care. 3. RELEASE AND WAIVER OF CLAIMS To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and agree not to bring claims against Ganesh Event Organizers, its organizers, hosts, volunteers, coordinators, committee members, sponsors, performers, agents, representatives, and volunteers (collectively, the "Released Parties") for claims arising from my attendance at or participation in the Event, including claims for personal injury, illness, death, or property damage, to the extent such claims may lawfully be released under applicable Georgia law. For clarity, HOA and Shiloh Woods community residents are also included among the parties intended to be protected by this release, and, to the fullest extent permitted by applicable law, the undersigned agrees not to hold the HOA or Shiloh Woods community residents liable for ordinary illness, injury, slips, trips, or falls arising from the undersigned's attendance at or participation in the Event. This release is intended to include claims arising from the ordinary negligence of a Released Party, to the extent permitted by applicable law. Nothing in this Agreement is intended to waive or release liability that cannot legally be waived or released under applicable law. 4. CULTURAL EVENTS AND PERFORMANCES I understand that the Event may include dances, skits, music, stage/performance activities, rehearsals, and other cultural performances. I voluntarily assume the risks associated with participating in or being near these activities, including accidental contact, falls, movement of performers, temporary performance areas, equipment, props, and other ordinary risks associated with performances. 5. TENTS AND TEMPORARY STRUCTURES I understand that tents and other temporary structures will be used at the Event. I acknowledge that temporary structures may involve risks associated with weather, wind, installation, movement, poles, ropes, stakes, flooring, lighting, equipment, and other related conditions. I agree to exercise reasonable caution around tents and temporary structures and to follow reasonable safety instructions provided by Event organizers. 6. CHILDREN AND MINORS Parents and legal guardians are responsible for the supervision and safety of children accompanying them to the Event. No child shall be considered to be under the supervision or responsibility of Ganesh Event Organizers merely because the child is attending the Event or participating in a cultural activity. If I am signing this Agreement as a parent or legal guardian, I represent that I have the legal authority to sign on behalf of the minor identified below. I acknowledge the risks described in this Agreement and agree to supervise the minor for whom I am responsible to the fullest extent required by law. 7. MEDICAL EMERGENCIES If I become ill or injured during the Event, I authorize Event organizers or their representatives, when reasonably necessary, to seek emergency medical assistance for me. I understand that Ganesh Event Organizers are not responsible for medical expenses, ambulance transportation, hospital expenses, treatment costs, medications, or other expenses arising from illness or injury. 8. PERSONAL PROPERTY I understand that I am responsible for my personal belongings. To the fullest extent permitted by law, Ganesh Event Organizers and the Released Parties are not responsible for lost, stolen, or damaged personal property, including phones, wallets, clothing, vehicles, or other belongings. 9. RESPONSIBLE CONDUCT I agree to behave responsibly and follow reasonable safety instructions from Event organizers. I will not intentionally engage in conduct that creates an unreasonable risk of injury or damage to another person or property. Ganesh Event Organizers reserve the right to ask any person to leave the Event if that person's conduct is unsafe, disruptive, threatening, or otherwise inappropriate. 10. INDEMNIFICATION To the fullest extent permitted by applicable law, I agree to indemnify and hold harmless Ganesh Event Organizers and the Released Parties from claims, damages, liabilities, costs, and reasonable expenses arising from my negligent or wrongful acts or omissions, or those of a minor for whom I am responsible, in connection with the Event. 11. ACKNOWLEDGMENT AND ACCEPTANCE This form is completed once per family/household. One adult family/household representative may provide the digital signature/acceptance on behalf of the participating family members listed on this form, provided that the signer has the legal authority to provide such acceptance for any minors. • I have read this Agreement carefully; • I understand the risks associated with attending and participating in the Event; • I understand that I am voluntarily assuming those risks; • I understand that this Agreement may limit certain legal rights; • I have had an opportunity to ask questions before signing; and • I voluntarily agree to the terms of this Agreement. I understand that this Agreement is intended to be legally binding to the fullest extent permitted by applicable law. IMPORTANT FAMILY ACCEPTANCE NOTE This waiver is intended to be completed once per family/household. The family/household representative should list every participating family member and provide one digital signature/acceptance. No separate signature is required from each adult family member. This form is intended to be one waiver/acceptance per family/household. The release includes Ganesh Event Organizers and, to the fullest extent permitted by applicable law, the HOA and Shiloh Woods community residents, as described in Section 3.
